Booking Terms

“We”, “Us”, ”Dublin Djs” “DJ”, “The Perfomer”,“Disc Jockey” “Our” = Dublin Djs
“Event” = Booking Date
“The Hirer”, “Client”, “You”, “Your” = shall mean any person upon whose behalf or on whose request Dublin Djs agrees to provide Services.
“Venue” = Location of the event

1. The Hirer
(a) The hirer is the person named on the quotations and booking invoices, and declares that he/she is over eighteen years of age and is legally entitled to enter to accept our terms and conditions on their own behalf. If they are entering into this agreement on behalf of a company or organization, that they have
full authority to do so.
2. Bookings
(a) Bookings can only be made with a valid credit card. We accept Visa, Visa Debit and MasterCard.
(b) Your booking is made through the Dublin Djs website booking engine which charges your credit card a €100 non-refundable deposit. The reaming amount or balance is payable upon the day of your event.
(c) Balance Payments are made directly to the performer. Cash, Credit Card or Bank Transfer payments are accepted. For Credit Card and Bank Transfer balance payments, there is a +12.5% Admin fee for payments made by credit card or bank transfer payable no later than 5 days before the event date. We do not accept cheques.
(d) Once your booking has been made you will receive a confirmation email with a booking reference number.
(e) The hirer agrees to hire Disc Jockey services, accessories and/or equipment described herein from Dublin Djs for the hire period and to pay the total hire fee and observe the conditions terms and covenants contained in these terms & conditions.
(f) When an booking is made, it should be carefully checked to make sure all details are correct, including date, time, venue and contact details.
(g) Once the booking deposit has been received, the hirer accepts these terms and conditions creating a 100% binding contract between Dublin Djs and the hirer under The Electronic Commerce Act, 2000, confirming a legal acceptance of these terms and conditions.

3. Consideration
(a) Dublin Djs will provide a DJ Service, which includes, and is not restricted to: a Disc Jockey, who agrees to provide a performance that is to the best of their ability, and reflects fully the likeness of the ‘DJ’ show. Sound reproduction equipment, Microphone, Speakers and Dancefloor Lighting for the negotiated
start time to finish time per the booking herein referred to as the ‘DJ’ and ‘Event’
(b) The DJ will make every effort to ensure their performance is outstanding, adhere to the client’s wishes within all reasonableness, be polite and courteous with the client, their guests and all venue staff and contractors
(c) If the DJ scheduled is unable to perform at the event date, we will provide an alternative DJ.
(d) The DJ will play within the scope of any playlist(s) provided, music genres selected and/or requests sent by email. If no playlists or special requests are received, the DJ will play at his/her own discretion.
(e) If there are any music requests that are outside the scope of the event, rare songs or music that would not normally be played at such an event, please mention them to us at the time of booking and we will ensure that we have them prepared for the event.
(f) Large venues and Hotels may require additional access times, have no parking, security restrictions or require setup during the day. If you are hiring a function room at a venue or hotel and you are unsure of setup times, please ask the management if daytime setup or additional access is required and
contact us with any details. If no details are provided to us, this may cause unnecessary delays.
(g) If the performance start time is delayed due to the inability of the DJ to gain access to the performance area, or any other delay beyond the DJ’s reasonable control, we will not be liable for any refund.
(h) If you are unsure of a function room size or the venue, please contact us and we will contact the venue directly.
(i) If a venue requires daytime setup only or the hirer requests daytime setup, there may be an additional charge for this service unless negotiated at the time of booking.
(j) Our equipment will be setup in one location of the venue for the duration of the event. We are not responsible for any delays if we have been advised to
setup in an incorrect location by the hirer or venue management.
(k) If a venue has multiple rooms, suites or locations for events, please let us know the name of your suite or function room as this will reduce delays in setting up.
(l) Please consider the location of the DJ area in relation to the rest of the venue and how the sound will affect the room. We will be unable to move to a different area after our equipment has been setup.
(m) If you are unsure of any of these conditions regarding the venue, please contact us and we will contact the venue management.

4. Fees & Payment
(a) All bookings are priced for a set playing time, any requests after the booking has been made and/or paid for to increase the set time, will be charged at an hourly rate of €50 per hour for the additional time required. This also includes any requests by the client or the venue after the booking has been made and/or paid for to arrive early to start or setup equipment. These additional costs will be due for payment on the day of the event.
(b) A booking deposit is required to secure your event date. We cannot under any circumstances accept bookings without a booking fee.
(d) We accept Visa, MasterCard or Visa Debit online or by contacting our office: 01 6877097 with your invoice number as reference.
(e) Details of all our payment methods and instructions are included with our booking Invoices.
(f) Deposits are non-refundable under any circumstances.
(m) We respectfully ask that you pay the balance amount due directly to the DJ or supervisor during setup or before the set starts. This way you can enjoy your night and it will not result in any delays.
(n) If payment is not made by the due date or on the night, the credit card used for booking will be charged any outstanding amounts within 24 hours from
the event date.
(o) In the event of non-payment, Dublin Djs retains the right to attempt collection through the courts. Client will be held responsible for all court fees, legal fees, and collection costs incurred by Dublin Djs. Client shall be charged €30 for each returned cheque plus a €7.50 service charge for each collection
notice.
(p) We do not accept cheques.

5. Cancellations
(a) If the event is cancelled by the hirer, there will be no refund of booking fees paid.
(b) Cancellations must be sent by email from the hirer’s email account. Phone or text cancellations will not apply.
(c) If the event is cancelled due to venue management, complaints due to noise levels or any other elements outside of our control, there will be no refund of deposit or payments.

6 Times
(a) We will play for the time quoted from start to finish. All times are quoted to the hour. If under any circumstances the event is to finish early due to the venue management or circumstances not within our control, there will be no refund of service.
(b) We will announce the final 3 songs of the night to prepare the audience for the closing of a set.
(c) We cannot accept payment to play for any additional playing time after the set has ended. Due to licensing laws, neighbours and security, the venue controls the length of time for parties and events including bar extensions and we cannot and have no place to overrule the venue’s terms. We respectfully ask that there are no requests of the DJ to continue playing at the end of his/her set or outside the closing times of the venue.6. Equipment
(a) We are responsible for our equipment at all times. Our equipment is defined as the equipment the DJ will bring to the venue and use for his/her set, this includes PA system, Speakers, Lighting & Microphones. The equipment will be packed away at the end of the night and removed from the venue.
(b) The equipment provided will ensure excellent sound for the event for the approximate number of guests as quoted. If there is an increase in the number of guests or a change of venue, we ask that you contact us immediately as depending on the venue, additional equipment including speakers, PA and/or
bass bins may be required. The hirer will be informed if there are any additional charges for sound equipment hire.
(c) Some venues or larger rooms may require additional lighting or effects, the lighting provided will be sufficient to the approximate number of guests per
the booking. If there is an increase in the number of guests or a larger room is booked at the venue, please contact us immediately as we may need to bring
additional lighting or effects. The hirer will be informed if there are any additional charges for lighting hire.
(d) Any additional equipment that is hired from us or hired from another party that requires the DJ to operate is the responsibility of the hirer, this includes Smoke Machines, Bubble Machines, Projectors or any equipment that requires the DJ to operate during the set.
(e) The DJ is not responsible for packing away any additional equipment provided by the hirer or removing it from the venue
(f) The DJ is under no obligation to operate, handle or maintain any equipment that the hirer has brought to the venue or from another company.
(g) Our laptops or any equipment will not be made available for use by the hirer or guests.
(h) Any theft of equipment will be reported to the hirer immediately and we reserve the right to charge for repair or replacement of any equipment damaged,
lost or stolen, during the period of the event. The hirer’s liability is for the full replacement value of the equipment and any cables.
(i) We are not responsible for venue power outages or any disruption of service caused by the venue.
(j) If we have been advised to “plug into” or use the venue’s equipment, as we have no control over it, we are not responsible for the quality of the sound or
any damage caused to the sound system including surges.

7. Damage
(a) The hirer is responsible for any damage to our equipment or vehicles caused by any guests during your event. You will be charged for the full cost of any
repairs and expenses incurred during the repair period. You will be advised of any damage as soon as it is caused and notified of the repair cost as soon as
possible.

8. Behavior
(a) We do not tolerate violent, aggressive or abusive behavior from anyone under any circumstances. We also reserve the right to terminate our services at
any time that we feel our personal safety is under threat. We do not take responsibility for ejecting any unwanted persons from any venue. You will be
advised of any problem that we may have in this respect with any of your guests.
(b) DJ’s are to perform in a safe, non-abusive environment. Any mistreatment or abuse of the DJ or anyone accompanying the DJ, in any way will result in
the immediate discontinuing of services.

9. Venue / Event Location
(a) We require a (min 4ft) table at the event location at all times. We need a minimum of 30minutes to enter a venue and set up prior to the start time and
also a similar time allowance at the end of the night to pack away.
(b) If you are booking other entertainment (e.g. singer, comedian, band, etc) as well as hiring ourselves, please consider the amount of space available and
where you are going to put the disco. Speaker location is usually best if it is no greater than 10 metres either side from the position of the presenter.
(c) If we are playing after a band and using the same stage, we will endeavor to setup as quickly as possible however we are not responsible for any delays
caused by the band removing their equipment.
(d) We reserve the right to refuse to continue any event prior to the start should there be insufficient floor space, which would not allow the audio and lighting
equipment to be assembled safely.
(e) We reserve the right to cancel or not continue an event if the venue is dilapidated, poses a safety/security risk or is a location of illegal activity.
(f) We are not responsible for the condition of dancefloors or dance areas.
(g) Any outdoor or marquee events are the exclusive responsibility of the hirer. The hirer is responsible for any damage caused due to weather, the volatility
of a marquee structure or outdoor stage including electrical surges or any damage caused to the outdoor venue by use of our equipment including stage
lighting.

10. Safety
(a) Dublin Djs are not liable in any way for any injuries that may occur due to the actions of the hirer and/or any of the hirer’s guests. This may include, but is
not restricted to drunkenness or other forms of intoxication.
(b) The “DJ Area” is defined as the location of the DJ, table and decks to include speakers, lighting and cabling locations within the venue.
(c) We ask that guests do not lean, stand close to or hold any speaker stands or freestanding equipment including lighting or stand or sit too close to
speakers and/or our PA systems as this may cause hearing loss or damage. There is no duty of care offered by Dublin Djs regarding guest’s actions and we
are not responsible for any accidents or damage caused by guest’s failure to move away from speakers or bassbins.
(d) The hirer is responsible for the safety of their guests at all times. Event are over 18’s and will invariably include alcohol, we are not responsible for any
attendee’s intoxicated actions at any time during the event.
(e) We respectfully ask that guests do not approach the DJ Area at any stage during the event unless requested, as there will be leads and cables on the
ground or surrounding the DJ Area, any tripping over of cables or leads may disrupt sound or effects and may result in a disconnection and damage causing
equipment to power down. We are not responsible for any damages suffered by guests negligence of tripping over cables or for any damage caused by
approaching the DJ area including speaker stands and lighting tripods.

11. Limitation of Liability
a) Nothing in these terms shall limit our liability for death or personal injury resulting from our negligence, or for fraud.
b) We will not be liable under these terms and conditions for any loss or damage caused whether or not by us or our employees or agents or other
members, in circumstances where:
i) there is no breach of a legal duty of care owed to you by us or by any of our DJs;
ii) such loss or damage is not a reasonably foreseeable result of any such breach;
iii) there is any increase in loss or damage resulting from breach by you of any term of this contract;
iv) the losses are business losses, and/or losses to non-consumers.

12. Force Majeure
Neither you nor us shall be liable for failure to perform or delay in performing any obligation under this agreement if the failure or delay is caused by
circumstances beyond your or our reasonable control, including but not limited to acts of God, war, civil commotion or industrial dispute (‘force majeure’). If
such delay or failure continues for at least 30 days, the party not subject to the force majeure shall be entitled to terminate our services by notice in writing to
the other. The party subject to the event of force majeure shall, as soon as practicable, give notice of the event to the other party, such notice to include a
reasonable forecast of the duration of the event.

13. Complaints
(a) Informal Complaints: Anyone who experiences a problem with DJ services provided by Dublin Djs should raise the matter directly to our office by email to: info@dublindjs.ie or by post to our address: 45 Dawson Street, Dublin 2 giving sufficient information and clearly outlining the grounds for complaint.
Dublin Djs will approach the DJ responsible for the event in question with a view to resolving the matter to the satisfaction of the complainant.
(b) Formal Complaints procedure: The formal complaints procedure should only be used where the complainant feels that the nature of the complaint is too
serious to be dealt with informally, or where a satisfactory conclusion has not been reached after following the informal procedure.

Grounds for a Formal Complaint:

Performer did not show up.
Performer’s equipment failed.
Performer was abusive, verbally or physically.
Performer caused damage to venue or other contractors.
Performer was under then influence of alcohol or narcotics
NB: Specific Song choices are not grounds for a formal complaint. The hirer has full control before and during the performance to select specific songs to play and not play during the set.

A formal complaint should be made in writing to Dublin Djs, we will acknowledge receipt and ensure that the matter is looked into as soon as possible. An initial response to any complaint can be expected within seven days of its receipt; a full and considered response to the complaint should be completed within 30 days and any subsequent remedy implemented with the minimum of delay.

14. General
Irish law will apply to this Agreement and both you and Dublin Djs agree to submit to the non-exclusive jurisdiction of the Irish Courts. All contracts that result from the use of our services are concluded in English. Relevant legislation governing these Terms & Conditions and our website: www.dublindjs.ie are the Sales of Goods (Supply of Services) Act, 1980, the Consumer Information Act, 1978, the Electronic Commerce Act, 2000, the EU Directive on Distance Selling, SI 207 of 2001 and SI 68 of 2003, the Data
Protection (Amendment) Act, 2003 and the Copyright & Related Act, 2000.
